Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the OnlyJoy.AI web application (the "Service") operated by JoyAI OÜ ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you must not access the Service.

1. Prohibited Uses

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:

• In any way that violates any applicable federal, state, local, or international law or regulation, including but not limited to laws and regulations in Anguilla;

• To transmit or procure the sending of any advertising or promotional material, including any "junk mail", "chain letter", "spam", or any other similar solicitation;

• To impersonate or attempt to impersonate OnlyJoy.AI, a OnlyJoy.AI employee, another user, or any other person or entity;

• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which, as determined by us, may harm OnlyJoy.AI or users of the Service or expose them to liability;

• To generate or transmit any illegal content, including but not limited to materials involving pornography, blood, alcohol, drugs, violence, or any content that violates any applicable federal, state, local, or international law.

Any violation of these provisions will result in a lifetime ban from the Service.

2. Intellectual Property Rights

The Service and its original content, features, and functionality are and will remain the exclusive property of OnlyJoy.AI and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of OnlyJoy.AI.

3. Generated Content

The images generated by the Service are intended for personal use only. You are not allowed to redistribute or use the generated images for commercial purposes without the prior written consent of OnlyJoy.AI.

4. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach the Terms.
All provisions of the Terms, which by their nature should survive termination, shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

5. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the Service.

6. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

7. Limitation of Liability

In no event shall OnlyJoy.AI, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

8. Indemnification

You agree to defend, indemnify, and hold harmless OnlyJoy.AI and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of European Union Jurisdiction, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.

10. Refund Policy

We offer a 14-day money-back guarantee for our Service from the date of purchase. If you are dissatisfied with our service for any reason, you may request a full refund within this timeframe. To be eligible for a refund, you must:
• Submit your refund request within 14 days of purchase.
• Provide a valid reason for the request and any supporting information as required by our customer support team.

To request a refund, please contact our customer support team through our website or via email at info@onlyjoy.ai. Provide your purchase details, including the email address used for the purchase, and the reason for the refund request. Our team will review your request and respond within seven (7) business days.

Upon approval of your refund request, we will initiate a refund to your original method of payment. Refunds may take up to 10 business days to appear on your statement, depending on your bank or payment provider. You will be notified via email once your refund has been processed.

Please note that our 14-day money-back guarantee does not apply to renewal payments for subscriptions. Only the initial purchase is covered by our money-back guarantee.

11. Billing Issues

For any billing questions including refunds on a case-by-case basis, please contact us via email at info@onlyjoy.ai.

Please note that there is no auto-renewal; we will not charge you automatically. Your plan subscription will expire at the end of the billing period, and your plan will be automatically downgraded. You can always manually renew your subscription by upgrading your plan.

12. Managing Your Plan

If you wish to change your plan, whether to upgrade or downgrade, please visit the pricing page and purchase a new plan.

If you have not fully utilized your current plan (i.e., if there is some usage remaining), you may be eligible for a full or partial refund, or a recalculation of usage for your new plan. In such cases, please contact our support team at info@onlyjoy.ai.

If you have recently run out of usage, you may repurchase the same plan, and your usage will be reset.

13. Complaints Policy

If you encounter content that you believe may be illegal or may violate our Prohibited Uses policy, you should report it by flagging it.

To flag a generated image, click the "Send feedback" button, then the "Flag image" button.

Alternatively, or for all other complaints, please contact us through info@onlyjoy.ai.

Complaints will be reviewed and resolved within seven (7) business days. That resolution will then be communicated to the Complainant. Appeals or requests for any decision made should be presented, again, to info@onlyjoy.ai.

During the review process, the content will be manually reviewed by our team. If any violations are found, the content will be immediately removed from our website, and necessary modifications will be made to our system to prevent future violations.
